Privacy Statement

Movida Nederland B.V. (Movida) respects your privacy and complies with privacy regulations. Movida ensures that the personal data collected about you or that you provide to Movida is processed confidentially and with the utmost care.

  1. Definitions
    A number of definitions appear frequently in this Privacy Statement. These are explained below for your convenience; please note that they may also appear in the plural form:
  2. GDPR: the General Data Protection Regulation, which took effect on May 25, 2018.
  3. User: any user of the Website.
  4. Client: any party that enters into an agreement with Movida pursuant to which Personal Data is processed.
  5. Personal data: any information relating to an identified or identifiable natural person.
  6. Privacy Statement: This privacy statement from Movida governs the processing of personal data.
  7. Movida: the private limited liability company Movida Nederland B.V., located at Ketelmeerstraat 182, (8226 JX) Lelystad.
  8. Processing: any (series of) actions, such as: the collection, recording, registration, editing, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, blocking, erasure, or destruction of Personal Data.

  10. What We Do
    Movida is a leading company that focuses primarily on telecommunications. Movida handles the delivery, installation, and maintenance of communications and telematics equipment and takes the hassle out of setting up telecommunications and telematics management systems for businesses. Movida also provides advice and support on telecommunications and telematics-related issues.

In order to achieve its goals, Movida processes Personal Data.

  1. The legal bases on which and the purposes for which we process Personal Data
    Movida processes your Personal Data only when:
  • it is necessary to properly perform the agreement we have entered into or will enter into with a Client;
  • The collection and recording of data—such as name, address, contact information, and bank account numbers—from (potential) Clients and their respective contacts—in order to fulfill assignments and draft contracts—may be necessary to properly execute the (potential) agreement with the Client.
  • Receiving, processing, and responding to business emails and phone calls—which involves processing your name, email address, and the content of your emails and phone calls—may also be necessary for the performance of the agreement between a Client and Movida. Movida also has a legitimate business interest in this regard.
  • Sending and receiving invoices may be necessary to comply with the agreement between the Client and Movida. Movida also has a legitimate business interest in this.
  • Processing your name, contact information, job title, device usage, device information, and installation preferences for the installation and repair work on your devices may also be necessary to fulfill the agreement.
  • Movida must comply with a legal obligation;
  • Maintaining financial records that include your name, address, job title, employee ID number, contact information, and financial transactions may be necessary to comply with a legal obligation, such as a tax obligation.
  • there is a legitimate (business) interest on the part of Movida (Movida will, of course, assess whether this would constitute a disproportionate infringement of your privacy);
  • Movida has a legitimate business interest in receiving, processing, and responding to business emails and phone calls, which involves processing your name, email address, and the content of your emails and phone calls.
  • Movida also has a legitimate business interest in maintaining and building a professional network that includes your name, contact information, birthday, gender, job title, and interests.
  • you have given your consent;
  • To process your email address and name so that we can send you newsletters and other informational messages. You may withdraw this consent at any time by sending an email to: privacy@movida.nl. Withdrawing your consent does not affect the lawfulness of any processing based on your previously granted consent.
  1. What Categories of Personal Data Do We Process?
    As described above for each purpose, Movida processes the following Personal Data necessary for the provision of its services:
  • personal information (first name, last name, and initials);
  • address information, place of residence information;
  • contact information, interests, birthdays, and gender;
  • position and professional activity of (contacts at) Clients;
  • device information, device usage, and device installation preferences;
  • browsing behavior, device information, and IP address;
  • Location data and mileage data
  • data other than that listed above, if such data must be processed pursuant to other laws and regulations.
  1. Who Receives Personal Data
    Movida provides Personal Data to parties that provide (processing) services to Movida, such as our external software vendors and newsletter provider. We may also share your data with other parties at your request in connection with data portability. Movida is legally required to provide data to government agencies, such as the Tax Authority. Movida may sell or transfer its business (in whole or in part). As part of such a sale or transfer, we may disclose Personal Data to anyone involved in the transaction.

Movida discloses Personal Data to third parties when required to do so based on a legal obligation, a legitimate interest, or the agreement entered into with the Client, or when permitted with your consent.

  1. What Rights You Have
    The GDPR sets forth a number of rights for you, which Movida is pleased to list below:
  • Right of Access: You have the right to request and review your Personal Data processed by Movida, and to verify whether, and in what manner, your Personal Data is being processed.
  • Right to rectification: If it becomes clear that your Personal Data is incorrect, you may submit a request to Movida to have it corrected.
  • Right to restriction: You have the right to ask Movida to limit its use of your Personal Data.
  • Right to erasure: You have the right to request that Movida erase your Personal Data.
  • Right to Object: You have the right to object to the processing of your Personal Data.
  • Right to Withdraw Consent: If we process your Personal Data based on your consent, you may withdraw that consent at any time.
  • Right to Data Portability: Under certain circumstances, you have the right to request your digital Personal Data in order to store it for personal (re)use. You also have the right to request that Movida transfer your Personal Data to another party.
  • Right to File a Complaint: You have the right to file a complaint with the supervisory authority: the Dutch Data Protection Authority.

We have a response period of four (4) weeks, starting on the day we receive your request. During this time, we will assess whether your request is justified. Based on your request, we may also ask for additional information, for example, to verify your identity. If we do not act on your request, we will explain our decision to you, and you will have the opportunity to file an objection. You may also submit this objection using our contact information.

  1. Confidentiality
    We safeguard your privacy interests and maintain confidentiality when processing Personal Data. In doing so, we comply with the obligations imposed on us by the GDPR. Movida employees handle Personal Data confidentially and are contractually bound to do so. Within Movida, Personal Data is disclosed only to Movida employees who, by virtue of their position, are authorized to have access to such Personal Data and where such access is consistent with the purpose of the data collection.
  2. Security of Personal Data
     Movida has taken the necessary measures to promote the physical, technical, and organizational security of privacy-sensitive data, so that the registration thereof is protected against unauthorized access, disclosure, alteration, and/or deletion of Personal Data, and also against fire and similar hazards, such as burglary and theft.
  3. What Retention Periods Apply
    Movida retains your Personal Data to achieve the purposes set forth in this privacy statement. Movida complies with (i) the statutory retention periods, such as a 7-year tax retention period, (ii) the guidelines of the supervisory authority, and (iii) the time limits it observes in the context of data minimization, whereby Movida operates on the principle that your Personal Data will not be retained for longer than is strictly necessary for the purpose.     Movida uses cookies on its website. Please refer to our cookie policy for more information about the cookies Movida uses.
  5. Google Analytics
    We use Google Analytics to track how Users interact with the Website and to measure the effectiveness of our AdWords ads on Google search results pages. Google Analytics collects your IP address and information about your browsing behavior on our Website, as well as the duration of your visit to our Website. Google uses this information to track how our Website is used and to provide us with reports about our Website. The information obtained in this way is transmitted to and stored by Google on Google’s servers. We also store the reports ourselves in our software system.

We have configured Google Analytics to be privacy-friendly. For example, your IP address is anonymized by removing the last octet, and Google is not permitted to disclose data to third parties or use it for other Google services. In addition, a data processing agreement has been entered into between Movida and Google. We have set the maximum retention period for the data to the shortest possible term, namely 14 months. This means that the data will be automatically deleted at the end of this period.

Changes to the Privacy Statement
Movida reserves the right to modify this Privacy Statement. In the event of a significant change, Movida will post a separate notice on its Website and notify you of the change. Movida also advises everyone, including Clients and Users, to check the Website regularly to determine whether any changes have been made.
